Terms and Conditions

In this document, “we,” “our” and “us” refer to Mill Wright LLC, its employees, and agents. “You” and “your” refer to the sender, its employees, and agents.

Goods are received in good order by Mill Wright except as noted, conditions, contents and quality unknown. Mill Wright LLC shall not be liable for lost, damage, delay or mis-shipment of goods, however caused. You are responsible for adequately packaging your goods. We may, at our option, open and inspect at any time freight being picked up, delivered, stored, or being tendered to Mill Wright by other means.

The limit of our liability under any circumstances in connection with any shipment or vehicle, whether consisting of one or more skids or cartons or vehicles, is limited to the lesser of your actual damages or $50.00 (Fifty-dollars) unless a declared value is submitted in writing prior to receipt of goods and applicable charges paid thereon.  You may pay an additional charge of ($1.50) for each $100 of declared value.  The declared value does not constitute, nor do we provide, cargo liability insurance. In any event, we will not be liable for loss or damage whether direct, incidental, special, or consequential in excess of the declared value of a shipment, whether or not Mill-Wright had knowledge that such damages might be incurred including but not limited to loss of income or profits.

Milll Wright LLC  is not legally liable for cargo loss and/or damage. All freight charges related to the freight lost / damaged has to be paid to Mill Wright LLC before processing any claim against Mill Wright or another nominated carrier involved in a shipment. Mill Wright LLC reserves the right to desist, deny or reject any freight claims assistance at any given time. Customers may not offset freight or other charges owed to Mill Wright against claims for any loss, damage, mis-delivery, or non-delivery.

In no event shall Mill Wright LLC be liable for any loss or damage caused by:

i. acts of God; public authorities acting with actual or apparent authority; strikes; labor disputes; weather; mechanical or equipment failures; cyber attacks; civil commotions; hazards incident to a state of war; acts of terrorism; acts or omissions of customs or quarantine officials; acts of carriers related to security; the nature of the freight or any defects thereof; inherent vice of the goods; perishable qualities of the merchandise; fires; frost or change of weather; sprinkler leakage; floods; wind; storm; moths; public enemies; or other causes beyond its control;

ii. fragile articles injured or broken, unless packed by Company’s employees and unpacked by them at the time of delivery;

iii. pilferage or theft, unless such loss or damage is caused by the failure of Company to exercise such ordinary care required by law; and

iv. concealed damage, or for losses incurred due to the concealed damage of the Goods.

All quotes are valid for 30 days unless expressly stated in writing by Mill Wright and are subject to change at any time without warning. Mill Wright will honor all General Rate Increases (GRI) that are announced and they will be applicable to all shipments affected whether an anticipated GRI was included in a quote or not.
